Terms of Service

1. Acceptance of Terms

By accessing and using the services of Pharos Steel Works, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services

Pharos Steel Works provides professional metal fabrication services including, but not limited to:

  • Sheet laser cutting
  • Pipe and tube laser cutting
  • Sheet bending
  • Steel rolling
  • CNC fiber welding
  • Powder coating

We reserve the right to modify, suspend, or discontinue any service at any time without notice.

3. Quotations and Pricing

3.1 Quotes

All quotations provided are estimates and are valid for 30 days from the date of issue unless otherwise stated. Prices are subject to change based on material costs, project specifications, and other factors.

3.2 Quote Acceptance

A quote becomes a binding contract only upon written acceptance by both parties. We reserve the right to refuse or cancel any order at our discretion.

4. Materials

4.1 Client-Supplied Materials

If you choose to supply your own materials, you are responsible for ensuring they are of appropriate quality, specification, and quantity. We are not liable for defects in client-supplied materials.

4.2 Our Materials

When we supply materials, we guarantee they meet industry standards and specifications agreed upon in the quotation.

5. Payment Terms

  • A deposit may be required before work commences
  • Payment terms will be specified in the quotation
  • Final payment is due upon completion unless otherwise agreed
  • Late payments may incur interest charges
  • We reserve the right to retain goods until full payment is received

6. Lead Times and Delivery

6.1 Production Times

Lead times are estimates and not guaranteed. We will make reasonable efforts to meet agreed deadlines but are not liable for delays caused by factors beyond our control.

6.2 Delivery

Delivery arrangements and costs will be specified in the quotation. Risk passes to the client upon delivery or collection.

7. Quality and Warranty

7.1 Quality Assurance

We are committed to delivering high-quality workmanship and will inspect all work before delivery.

7.2 Warranty

We warrant that our workmanship will be free from defects for a period of 90 days from delivery. This warranty does not cover:

  • Normal wear and tear
  • Damage caused by misuse or improper installation
  • Defects in client-supplied materials
  • Modifications made by third parties

8. Inspection and Acceptance

The client must inspect goods upon delivery and notify us of any defects or discrepancies within 7 days. Failure to do so constitutes acceptance of the goods.

9. Cancellations and Changes

9.1 Client Cancellations

Cancellations must be made in writing. Cancellation fees may apply for work already completed or materials purchased.

9.2 Project Changes

Changes to project specifications after quote acceptance may result in additional costs and extended lead times.

10. Liability

10.1 Limitation of Liability

Our liability is limited to the cost of the services provided. We are not liable for:

  • Consequential or indirect losses
  • Loss of profits or business opportunities
  • Delays beyond our reasonable control

10.2 Indemnity

The client indemnifies us against any claims arising from the use of our products or services, except where caused by our negligence.

11. Intellectual Property

All designs, drawings, and specifications created by us remain our intellectual property unless otherwise agreed in writing. The client may not reproduce or use them for purposes other than the agreed project.

12. Confidentiality

We respect the confidentiality of client information and project details. We will not disclose such information to third parties without consent, except as required by law.

13. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, strikes, or government restrictions.

14. Dispute Resolution

Any disputes arising from these terms will be resolved through good faith negotiation. If negotiation fails, disputes will be subject to the jurisdiction of South African courts.

15. Governing Law

These Terms of Service are governed by the laws of South Africa.

16. Changes to Terms

We reserve the right to modify these terms at any time. Updated terms will be posted on our website with a new effective date.
